Amendments and Revisions to Terms and Conditions

  1. We may update these Terms and Conditions from time to time by updating the terms on our website [insert URL for notice]. You should check the website from time to time for any amendments. These Terms and Conditions are effective from [insert date].

Terms of Use

  1. Vicast shall render memory and computing capacity available, on a server operated by Vicast, for the operation of applications that can be utilised via the internet.
  2. Vicast shall create, grant and maintain the connection between the server and the internet so that the any data stored on the server by the User can be transmitted without disruption by means of the common internet protocols.
  3. Vicast shall endeavour to make the data continuously available to the User via the internet but does not accept liability for unsuccessful access insofar as networks are used that are not exclusively operated by Vicast or its authorised sub-contractors.
  4. If disruptions of system availability occur, the User shall inform Vicast immediately. Vicast shall use all reasonable endeavours to remove the disruption of availability as soon as possible.
  5. Vicast may carry out maintenance for the optimisation and improvement of performance of Vicast’s systems. During these times, access may be restricted or prohibited.
  6. Vicast shall back up the stored data on a [daily basis] and shall store copies of said data for a period of [XX] days.
  7. Vicast accepts no responsibility for the content of the User’s saved data or the saved contents. Vicast does not accept liability for any damage suffered by the User due to alterations of the saved data by the User or any other user.
  8. The User shall not upload viruses or malware of any kind.
  9. Vicast is not liable for any damage caused by the circumvention of password protection and similar protection facilities through “hacking” on the server used by the User.

 Ownership of Content

  1. The User is the owner of the content posted and remains responsible for maintaining their data on the server.

Software

  1. The User will not modify, create derivative works or otherwise use Vicast source code. The User has no right to access or use the source code or constitute any licence of the source code.
  2. The User shall not decompile, reverse engineer, disassemble or attempt to derive the source code of the software, save only to the extent permitted by law

Content

  1. The User will not post content that infringe or violates any third party individual or organisations rights or otherwise breaches any applicable law.
  2. Vicast reserves the right to remove any content which it, in our absolute discretion, considers to be in any way illegal, infringes a third parties right or which Vicast deems to be objectionable or inappropriate.
  3. In using our Services the User agrees and undertakes not to post any content which infringes any third party’s intellectual property rights.
  4. In using our Services the User agrees and undertakes not to post any content which identifies or discloses personal data or information about any third party without their consent.
  5. Vicast is entitled to disrupt the connection between the stored data and the internet on a temporary basis if Vicast, in their absolute discretion, identify content which it deems to be illegal, infringes the rights of any third party or is in breach of these Terms and Conditions.

Dispute Resolution Procedure

  1. If a dispute arises out of or in connection with these Terms and Conditions or the performance, validity or enforceability of them (Dispute), the User shall give to Vicast written notice of the Dispute, setting out its nature and full particulars (Dispute Notice), together with relevant supporting documents. On service of the Dispute Notice, the parties shall attempt in good faith to resolve the Dispute. If the User and Vicast are unable to resolve the Dispute within 30 days of service of the Dispute Notice, either party may proceed to litigation or any form of alternative dispute resolution as it considers appropriate.

Governing Law

  1. These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with Scots law.

Jurisdiction

  1. The Scottish Courts shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or their subject matter or formation.
